To follow up on Jody’s post… I thought it appropriate to share the Prezi I used to go through some key/important EdTech legal topics for the school leaders to be knowledgeable on. As Jody stated, “I’m no lawyer, so these are just ideas… Consult with your legal folks and administration.” BUT, definitely use the skills you were given, click some links, and form some ideas on your own about what the regulations, laws, and acts are trying to get at. Understand the intent and be able to have a discussion about them. If there is any level of risk and you still want to do it, consult your leadership (run it up the chain – see what happens).
Most importantly, nobody can answer every question off the top of their head. Example: What does the YouTube terms of use state about holding an account to upload video. Answer = go look it up, take in to account what you know about federal and state law and try to understand the language the best you can.
The point here is: DON’T get yourself into a situation where you are just plain “reckless.” Not knowing is not an excuse. But don’t let the fear of the unknown keep you swimming in a liability swamp. While I’m on it, trying to do things to avoid liability doesn’t make sense to me. As I was told by legal folks, you can be sued for liability by anyone at anytime, period. And you are liable if a jury says you are.
We are currently working with a group of great folks to help put some model procedures together, with the intent of getting infront of KSBA to capture the new components of the law (see prezi). We’ll see where that goes, and I’ll report back.
